Energy Disclosure Regulations
Energy disclosure regulations are advancing. Recent modifications have been made to the draft regulations. The regulations will require the owners of commercial properties to disclose energy usage to prospective buyers "at or before the time the owner presents a sales contract for the entire building to a prospective buyer."
Separate implementation times are established ranging from January 1, 2011 for owner occupied building and those over 50,000 square feet to January 1, 2012 for those 10,000 to 50,000 square feet and July 1, 2012 for those under 10,000 square feet. The regulations also address the duty of utility companies to provide information and obtaining consent from certain tenants’ for the release of energy data.
