The United States Supreme Court has refused to hear an appeal of a California case seeking to require MERS to prove that the owner of the note granted MERS the authority to foreclose. The California Supreme Court had earlier declined to review the case of Gomes v. Countrywide. Since the California Supreme Court had decided not the review the case it made it very unlikely that the U.S. Supreme Court would hear the case.
