On December 12th the Energy Commission adopted regulations for the Nonresidential Building Energy Use Disclosure Program. The regulations require building owners to electronically complete and submit a compliance report. The report is accessible by the Energy Commission and is based on energy use dated submitted by the utility. Once the new requirements kick in an owner must benchmark the energy use and make disclosures in advance of the sale, leasing or financing of the entire building. Compliance dates vary based on the square footage of the building and take place in three stages starting with July 1, 2013 for the largest buildings, then on January 1, 2014 and finally on July 1, 2014 for buildings from 5,000 to 10,000 square feet of gross floor area.
