CLTA Makes Technical Form Changes

The CLTA recently filed changes with the California Department of Insurance to the following three CLTA forms: 

CLTA Form 101.4 (05-06-16) | Mechanics Liens, No Notice of Completion

CLTA Form 101.4 (05-06-16) was modified to further clarify the intent of the title insurer that there is no coverage for mechanics liens arising out of post policy work. The proposed changes will read as follows:

The Company hereby insures the insured against loss which the insured shall sustain by reason of any statutory lien for labor or material attaching to the estate or interest referred to in Schedule A arising out of any work performed or materials provided prior to of improvement under construction or completed at Date of Policy.

CLTA Guarantee Form No. 22 (05-06-16) | Trustee’s Sale Guarantee

Guarantee Form No. 22 (05-06-16), the Trustee’s Sale Guarantee, modified paragraph 2 of the Information Notes page, which calls attention to the federal Servicemembers Civil Relief Act (SCRA) which is cited as “Appendix 50 USC §§ 501 et seq.” Effective December 28, 2015, the cite for SCRA has changed to: “50 USC §§ 3901 et seq.”

CLTA Preliminary Report Form, Exhibit A (05-06-16)

The CLTA Preliminary Report, Exhibit A was updated to reflect the currently filed ALTA Expanded Coverage Residential Loan Policy - Assessments Priority. The language in Exhibit A regarding the policy is now consistent with the currently filed ALTA Expanded Coverage Residential Loan Policy - Assessments Priority
