Indians: Findleton v. Coyote Valley Band of Pomo Indians

The court of appeal reversed the trial court's dismissal of this action to enforce arbitration provisions in contract between plaintiff and the Tribe, finding that the Tribe's General Council authorized the Tribal Council to waive the Tribe's sovereign immunity. Interpreting the Tribe's Constitution, the court held that the General Council's authorization was properly given by means of a resolution adopted by majority vote at a meeting of the General Council, and did not need to be accomplished through the initiative or referendum process.
