Overtime Rules Put on Hold

A federal judge enjoined the overtime rules set to go into effect on December 1. The judge decided that increasing the salary exemption for overtime to $47,476 basically created a de facto salary test rather than the test created by Congress of whether an employee was employed in a bona fide executive, administrative or professional capacity. Groups challenged the new overtime rules on the basis that they substituted a salary test for the duties test. Many employers already made adjustments because of the new rule. However, some states, such as California, have their own rules for overtime that are not affected by the federal injunction.
