CLTA Warns At-Risk Groups of Impact of Recording Fee Increase

CLTA Executive Vice President and Counsel Craig Page sent a letter to a number of advocacy groups notifying them of the potential impact of increased recording fees if Senate Bill 2 (Atkins) becomes law. Under SB 2 a new $75 recording fee would suddenly add to the burden of those least able to afford the fee hike. The groups notified of the proposal and its impact included the AARP, Center for Responsible Lending, and the Center for California Homeowner Association Law, as well as others.

In his letter, Mr. Page emphasized the heretofore-unacknowledged impact an increase in recording fees would have on certain at-risk groups, including seniors on fixed incomes who may need to record a number of documents following the death of a spouse, as well as homeowners seeking a loan modification to avoid foreclosure. In both cases, the recording fees would increase dramatically under SB 2 – between 500% and 700%. This increase hits our fellow Californians who are struggling and often overwhelmed by their circumstances.
