NAIC Continues to Explore Cyber Security

As the CLTA reported last June, the NAIC Cybersecurity Task Force received feedback from interested parties, including the title industry, on the draft "Insurance Data Security Model Law." The recent NAIC Denver meeting saw the New York representative suggest that the new New York cyber security regulation should serve as a road map for a regulatory framework.

California already has the Insurance Information and Privacy Act (IIPA) and regulations adopted by the Commissioner. California also has its own law on disclosures of data breaches and various laws on the protection of non-public personal information. The ALTA and other insurance trade associations have expressed concerns to the NAIC about creating additional requirements on top of the federal Gramm-Leach-Bliley Act and existing state data breach notification laws, such as exist in California.

The NAIC has struggled for some time to reach a consensus on a draft model act but hopes to have a revised draft soon after their April meeting.
