Correcting Indexing Upon Request and Providing Relief from Liability

Assembly Bill 794 (Gallagher) requires recorders to correct an indexing mistake within 10 days, if the recorder receives a request within 30 days of the original indexing. AB 794 also proposes to eliminate the liability of a recorder for certain acts if the recorder exercises reasonable diligence in its obligations. The legislation also states that the due diligence requirement would be considered satisfied if a recorder has incorporated the use of an automated program with a high rate of accuracy.
