Senate Bill Seeks to Place Limitations on Sale of Federal Property

Senate Bill 50 (Allen) would restrict conveyances of federal public lands by declaring conveyances from the Federal Government void ab initio unless the State Lands Commission is provided with the right of first refusal or the right to arrange the transfer to a third party.  The State Lands Commission is authorized to seek declaratory and injunctive relief to contest conveyances. Furthermore, the bill prohibits anyone from knowingly filing or recording a deed, instrument, or other document related to the federal conveyance unless it is accompanied by a certificate of compliance.  

An analysis of the bill conducted in the Senate Judiciary Committee notes that SB 50, were it to pass, would likely be challenged in court on whether or not it is constitutional.
