CLTA Supports Review by California Supreme Court

The CLTA filed a request with the California Supreme Court asking the court to accept a case for review relating to lien priority. The opinion in Nautilus, Inc. v. Urban Financial Group, Inc., upheld the decision of the trial court to create an equitable lien based on a money judgment superior to a prior recorded deed of trust. The CLTA is concerned that California’s “first in time, first in right” principle is threatened by undermining the process of creating a lien based on a money judgment by recording an abstract of judgment. The decision conflicts with well-established lien priority law and creates a great deal of uncertainty that merits review by the Supreme Court.
