CLTA Joins Coalition Opposing Expansion of Government Subpoenas

The CLTA has joined a business coalition opposed to Assembly Bill 814 (Bloom), granting pre-litigation administrative subpoena powers to city attorneys.  The city attorney’s role is to provide legal advice to city government, prosecute criminal misdemeanors, defend the city on civil matters, and protect the city from legal liability.  The legislation would provide city attorneys with the ability to perform unwarranted searches on businesses and organizations before ever filing an action alleging wrongdoing.

In a letter opposing the bill, the aforementioned coalition of opposition argued that the extensive and far-reaching investigatory powers that would be authorized under AB 814 should continue to remain the sole authority of the California Attorney General and District Attorneys, and not local city attorneys.
