Legislation to Expand Governor Subpoenas Falls Short of Passage

A business coalition led by the Civil Justice Association of California and including the CLTA was successful in blocking the passage of AB 814 (Bloom) in the final days of session. AB 814 would provide city attorneys with the ability to perform unwarranted searches on businesses and organizations before ever filing an action alleging wrongdoing.

In a letter opposing the bill, the coalition argued that the extensive and far-reaching investigatory powers that would be authorized under AB 814 should continue to remain the sole authority of the California Attorney General and District Attorneys, and not local city attorneys.

The measure was brought up for a vote on the Senate Floor in the second-to-last week of session, but lacked the votes necessary to pass. It was then placed on the inactive file before being brought off in the final few days of session, but again lacked the votes and was tabled.
