CC&Rs Declared Void if Similar Reconstruction Prohibited After a Disaster

Senate Bill 625 (Wahab) addresses reconstruction of destroyed or damaged structures where there has been a disaster.

​One of its provisions would make any covenant, restriction, or condition and any provision of a governing document, void and unenforceable if it has the effect of prohibiting, a substantially similar reconstruction of a residential structure that is damaged or destroyed during a declared disaster or state of emergency. The legislation has passed the Senate and is now pending in the Assembly.
