CLTA has updated its California Anti-Rebate Law Training Manual, a generalized informational template intended to provide CLTA members with readily accessible material on the requirements of California law relating to the marketing of title insurance under Insurance Code Section 12404 and related provisions. The Training Manual, which was first published in 2008, was most recently updated to incorporate additional guidance from the California Department of Insurance regarding its general approach and priorities in enforcing the anti-rebate provisions of the California Insurance Code. Specifically, the Training Manual was updated in areas relating to: trade association and/or network group participation, rate adherence, social media, and publicly available information, among other topics. The updates to the Training Manual were reviewed by the Department prior to their final incorporation.
CLTA members are encouraged to carefully review the updated Training Manual in consultation with their market practices staff and legal counsel, and should feel free to adapt and use the information contained within the Training Manual according to their own needs and interpretation of the law.
