Effective January 1, 2009, California Senate Bill 133 (Ch. 280, 2008) amended California Insurance Code Section 12404 to strengthen existing prohibitions against unlawful inducements for the placement or referral of title insurance business, including by expanding the list of activities deemed per se inducements. The law also added Insurance Code Section 12418 to establish a certificate of registration requirement for “title marketing representatives,” or those individuals who market, offer, solicit, negotiate, or sell title insurance in California.
