Governor Vetoes Gender Data Bill but Signs Significant Employee Protection Legislation

Governor Brown vetoed legislation, Assembly Bill 1209 (Fletcher), that would have required employers with 500 or more employees in California to collect data on gender pay differentials for both exempt employees and its board of directors. However, Governor Brown acted to promote salary equality when he signed Assembly Bill 168 (Eggman) that bars prospective employers from asking for salary history. The new law goes further than merely prohibiting asking for salary information, because it also prohibits the use of salary history information in hiring decisions. Additionally, in an expansion of employee benefits, the Governor signed the New Parental Leave Act, Senate Bill 63 (Jackson). The act requires unpaid leave for new parents employed by businesses with at least 20, but less than 50, employees. There are eligibility requirements relating to length of employment and number of hours worked.
