Homeowners Bill of Rights Renewal

Tuesday, January 16, 2018

Several provisions of the Homeowners Bill of Rights, a law enacted in response to the foreclosure crisis that resulted from the housing collapse, expired on January 1, 2018. In response, State Senator Jim Beall, along with a number of co-authors, has introduced Senate Bill 818 (Beall) to revive a number of the expired provisions.

Portions of the newly introduced bill look to address foreclosure prevention alternatives, such as providing notices regarding loan modification and prohibiting foreclosures while loan modification applications are pending. This latter process is referred to as a dual track.
