CLTA Exploring eNotarization Options as ALTA Collaborates with MBA on Model Online Notary Bill

The Mortgage Bankers Association (MBA) and the American Land Title Association (ALTA) have collaborated on a model remote online notarization act for states to consider. The model act has its foundation in the Texas law but with changes to make it apply as a multistate model. The model act has procedures for remote notarization as a option. If a state adopts the model, the Secretary of State would be required to develop and maintain standards for remote online notarization in accordance with the bill, including standards for credential analysis and identity proofing. The secretary of state would be required to review and consider the standards established by the National Association of Secretaries of State and national standards setting bodies such as the Mortgage Industry Standards and Maintenance Organization when developing those standards.

Separately, the California Land Title Association has crafted a remote/electronic notarization proposal and is vetting it with members of the lending and escrow industry, as well as the California Secretary of State’s office.
