Reinstatement Proposed for Expired Portions of the Homeowner's Bill of Rights

Portions of the Homeowner’s Bill of Rights (HBOR) enacted in response to the foreclosure crisis expired on January 1, 2018. Senate Bill 818 (Beall) seeks to reinstate the expired provisions. There is a concern that reinstating the requirements after a lapse will complicate loan servicing requirements for non-performing mortgages and impact housing financing costs. Since the foreclosure crisis, national mortgage servicing standards were adopted in 2014. Mortgage servicers are still required to comply with the unexpired portions of the HBOR that applies to California loans, regardless of the number of foreclosures experienced by a mortgage servicer.
