CLTA Voices Opposition to Asset Forfeiture Bill

Assembly Bill 3208 (Cooper) would permit the City of Elk Grove to, in an attempt to combat the operation of illegal marijuana grow houses, adopt an ordinance allowing the city to confiscate and seek an order of civil forfeiture of real or personal property for violations of the city’s ordinances. The CLTA is opposed to the measure, arguing that the bill undermines the real property and constitutional rights of homeowners by allowing the seizure of assets without a criminal conviction, and that it runs contrary to legislation signed into law in 2016, which strengthened asset forfeiture protections for California real property owners.
