Private Right of Action for Privacy Violations Stalls in Senate

Legislation that would expand a consumer’s ability to bring a civil action for violations of the California Consumer Privacy Act of 2018. and that would remove the ability of a business to cure an alleged violation of the act, was held in the Senate Appropriations Committee. The bill, Senate Bill 561 (Jackson), had previously passed the Senate Judiciary Committee on a 6-2 vote. The bill is sponsored by the Attorney General and supported by the Consumer Federation of California and the Consumer Attorneys of California. However, SB 561 was opposed by a broad coalition of business groups, including the California Land Title Association.
