Comprehensive Housing Bill Amended

Senate Bill 50 (Wiener), a landmark attempt at comprehensive housing reform, now in its third year (considering its predecessor SB 827), was recently amended. The bill seeks to override local zoning that restricts the construction of apartments and affordable housing, and seeks to implement strong tenant and anti-demolition protections. Prior attempts to pass the bill have met with opposition from local government.

The amended bill gives local governments two years to craft an equivalent SB 50 plan, certified by the state to meet the SB 50 goals. If a local government does not adopt a plan that is certified by the State, then the SB 50 provisions govern. For a local plan to qualify it must not increase vehicle miles traveled (VMT), an attempt to encourage zoning for housing in areas connected to jobs and transit. Local plans submitted under the amended provisions would also be required to not violate fair housing principles, for instance by having a disparate treatment on low-income communities.
