Employee Training Law Update

Last year the Legislature passed Senate Bill 778 to amend a law requiring companies with five or more employees to provide at least two hours of sexual harassment training to supervisory employees and one hour to all non-supervisory employees by January 1, 2020. SB 778 extended the date to January 1, 2021. Due to the change, employers will therefore be required to provide the training to meet the January 1, 2021 deadline. Companies must train new non-supervisory employees within six months of hire, while new supervisory employees must receive training within six months of assuming a supervisory position.

The training must include prevention of abusive conduct, and cover harassment based on gender identity, gender expression, and sexual orientation. Also, beginning this year, all temporary employees hired to work for less than six months must receive training within 30 calendar days. In instances wherein the employee is employed via a temporary employee service the temp service is required to provide the training.
